I Have Brain Cancer, My Child's Father Wants To Get Full Custody Of My Child. Can He Take My Child From Me?

396545116 ever sense i filed for child support, my childs father wants to say that my illness makes me enable to care for my child. i have had a brain tumor for over 3 years now, and my tumor is stable, and have not progressed. can he take my four year old daughter away from me?

  1. Gilda - It's not likely, if you are providing adequate food, clothing, and shelter and the child is doing fine with you. Dads (well, whichever parent doesn't have custody) always try to come up with some excuse to get out of paying support. Don't sweat it!

  2. Meg - If I were you I would get some professional legal advice. The custody of a child is not clear cut and depends a lot on how determined your child's father is and how much he really wants custody and is willing to pay to achieve that outcome. There was a highly publicised case recently (although I can't remember the name) where a woman lost custody because she had breast cancer. It's always better to be forewarned and prepared in these cases. Know your legal rights and find out if there is anything you can do to help your case down the track.

  4. imperialpoetpurple - The diagnosis by itself shouldn't affect custody -BUT you really need to consult with a lawyer about this matter instead of Yahoo Answers because the legal issue can be complicated by many factors other than just your own opinion/persepective about your medical condition. You do need child support and you do have a major illness. Your husband doesn't want to pay child support, but does want full custody. Think about how that sounds ie. he wants full custody instead of paying child supportHmmmm... Yahoo Answers vs. a Lawyer for advice? Hmmmm... Yeah, you need to talk to a lawyer. Sounds very stressful too. I believe you would also benefit from social services ie. contacting a medical social worker...to actually help you with these serious problems...
